Remember the ruckus they stirred up when they couldn't defend all the immigrants from the red dragon ? That was what happened when people assumed they were shirking their duties and caused the deaths of some due to incompetence . What do you think would happen if they used a Nuclear Bomb ? Gross overkill that many people would call unnecessary and barbaric . The military's approval would sink like a stone . | First of all, JSDF doesn't have nukes. At least, officially - everybody knows Japan can make their own nukes quite fast, should they decide to do so. Second, Japanese really hate nukes. Ever wonder why all those big bombs in anime aren't called nukes? Because they don't like nukes. Because they're the only nation who actually had nukes used against them. So, it is very unlikely that anime JSDF will be allowed to use nukes. Real JSDF wouldn't get nukes for fighting defenseless primitives either. |

The law there is fungible, but for the sake of domestic politics and international relations (and just avoiding messy legal action), it is extremely prudent to treat all non-human civilizations as they would humans. While they could argue from a legal standpoint, it's just not going to fly for the Japanese people. And foreign nations can be expected to take the position that best benefits them, which is that Japan is in violation and the "special region" needs to be under international control.
